Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Cook Islands Carbon Neutral Wedding” Contest (the "Promotion") will begin at 12:00am Eastern Standard Time (EST) on March 26, 2010 and end at 11:59pm Pacific Standard Time (PST) on June 30, 2010 ("Promotional Period), who is solely responsible for all aspects of this Contest. 

Eligibility: The Contest is open to all legal residents of the 50 United States, the District of Columbia, and Canada (excluding Quebec), 21 years of age or older as of March 24, 2010. In addition, participants must be engaged to be married OR prepared to be married in late September 2010, in order to enter the Contest. This promotion is not open to the general public. Employees, officers, directors and representatives of the Sponsor, and their respective parent company, affiliates, subsidiaries, licensees, service providers, advertising and promotion agencies, those involved in the production, development, implementation or handling of the Contest, any agents acting on behalf of the above entities, as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each are not eligible to participate in the Contest. All federal, state and local laws and regulations apply. Void where prohibited, taxed or otherwise restricted by law.

How to Enter:  1). Eligible participants can enter the Promotion at http://www.cookislandsgreenwedding.com and completing the online Contest registration (name, address, date of birth, gender, telephone numbers {day and evening}, email address). After basic registration, participants will be asked to write a 50 word (or less) essay explaining why they think that they are the ultimate eco-friendly couple. All entries must be received by 11:59pm PST on June 30, 2010, to be eligible to enter to win the Grand Prize. The Sponsor reserves the right to disqualify any person or email address that submits more than one entry regardless of entry method. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by the Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which is final and binding in all matters relating to the Sweepstakes. Internet Limitations of Liability:  If for any reason, this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right, at their sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of the termination/suspension date.  The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any email or entry to be received by the Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof.  The Sponsor is not responsible for any damage to an entrant’s system which is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes. The Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest.  Any dispute or claim arising out of the play of this Contest, or any dispute with site users which arise as a result of the use of this website, shall be governed by the laws of the State of New York, without respect to conflicts of laws principles. Any such claim shall be brought and maintained in the federal or state courts of the State of New York.  If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Terms of Submission: For purposes of this Section, all material submitted by an entrant, including but not limited to any name, likeness, image, recipe and/or story of recipe development, shall be referred to as the "Submission". By entering, you represent and warrant that (i) your entire Submission is an original work by you and you have not copied or used other works in your Submission without permission or right to do so; (ii) no person, other than you has any right, title or interest in any part of your Submission; (iii) your Submission will not infringe or violate any rights of any third party or entity, including, without limitation, trade secret, copyright and trademark, defamation, privacy and publicity, false light, idea misappropriation or any contractual rights; (iv) you have all the rights, licenses, permissions and consents necessary to submit the Submission in accordance with these guidelines.

Any Submissions containing material that is violent, pornographic or otherwise obscene, illegal, inappropriate, or racially or morally offensive, or does not meet Sponsor's standards for any reason as determined by Sponsor, in their sole discretion, may be rejected as ineligible for consideration. Entries must comply with all laws, rules, and regulations including, but not limited to, those concerning copyright, plagiarism, trade secrets, trademark, defamation and invasion of privacy.

By entering, you agree that: (i) all Submissions become Sponsor’s property and will not be returned, (ii) Sponsor and their licensees, successors and assigns have the right to use any and all Submissions, and any and all names, likenesses, voices and images of any kind appearing in the Submission, for future advertising, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity.

By sending any Submission, entrants are at such time granting Sponsor, their affiliates and licensees, successors and assigns a worldwide, royalty-free, perpetual, unrestricted, irrevocable and fully sub-licensable right and license to consider, disclose, broadcast, use, re-use, reproduce, modify, digitize or enhance, adapt, change, edit, publish, translate, create derivative works from, distribute, re-distribute, and/or display your Submission (in whole or in part), and any and all images or likenesses that appear in your Submission (in whole or in part) and/or incorporate all or part of your Submission in other works, all in any manner and in any form, format, media or technology now known or later developed or invented anywhere in the world at any time, as well as in connection with any distribution or syndication arrangement with third parties or third party sites, in any media format or medium and through any media channels and for any purpose, including, without limitation, downloads, streams, in audio visual recordings, motion pictures, television programs, productions, advertising, promotion and publicity, all without further notice to, consent from or payment to you. You waive any and all "moral rights" you may have in the Submission. You grant Sponsor these rights whether or not you are selected as a semi-finalist, finalist or Grand Prize Winner. YOU WILL NOT BE PAID FOR YOUR SUBMISSION or for granting Sponsor any of these rights. Sponsor, their affiliates and licensees, successors and assigns are in no way obligated to use your Submission (and have no obligation to you or any other person or entity after your Submission is received), and you may not be given any credit if your Submission is used. Sponsor may elect to post any, all, or none of your Submission on the air, in on-air promotional spots, on Sponsor’s websites or elsewhere, including other websites, as set forth in these rules. If Sponsor does elect to use your Submission or any part thereof, Sponsor may remove all or any part of it at any time for any or no reason, and Sponsor may use all or any part of it in any way that Sponsor elect, in its sole discretion. You agree to waive all claims to and shall receive no royalties of any kind now or in the future from Sponsor, their affiliates or licensees, successors and assigns for any use of your Submission, including copyright or trademark royalties, and you represent, warrant and agree that no other party is entitled to claim royalties from the use of the Submission as set forth in these Official Rules.

You acknowledge that your Submission will not be acknowledged or returned. You acknowledge that this Submission is sent voluntarily, and not in confidence, and that no confidential relationship is intended or created between you and Sponsor by the submission of the Submission. You recognize that other persons, including Sponsor’s own employees, may have submitted to Sponsor or others, or made public, or may in the future originate and submit, or make public, similar or identical material that Sponsor may have the right to use, and that you will not be entitled to any compensation because of Sponsor’s use of other similar or identical material. Nothing in this Agreement, or the submission of the Submission, shall be deemed to place you in any different position from any other member of the public with respect to the Submission.

Judging: All eligible entries will be judged and scored by qualified employees and agents of the Sponsor ("Judges"), in their sole discretion, on the basis of Pertinence to Theme (50%), Creativity (25%), and Inspirational (25%). All decisions by the Sponsor and judges are final.

Winner Notification: The Potential Grand Prize winner will be notified and qualified on or about July 10, 2010, by American Sweepstakes & Promotion Co. (“the Administrator”) an independent judging organization, whose decisions are final and binding in all matters relating to this Contest. Potential winner will be notified by phone and/or mail according to the information submitted by the winner. Upon initial notification and verification of potential winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of the Sponsor’s choice.

Prizes: One (1) Grand Prize winner will receive the ultimate green wedding for a bride & groom and four (4) of their friends/family members. The Grand Prize winner and travel companions must travel on September 4th, 2010, and the wedding will take place on September 9th, 2010. The prize package will include six (6) days in the Cook Islands, roundtrip international airfare on Air New Zealand from Los Angeles to Rarotonga, Cook Islands for six (6) people, five (5) nights’ accommodation (3 rooms) at Pacific Resort Rarotonga, a wedding license, wedding ceremony and celebration on the beach of Rarotonga, and Cook Islands departure tax. The Grand Prize package will have an Approximate Retail Value (“ARV”) of $15,000. Seats are subject to availability at the time of booking. No wait-listing and no open date sectors. Extensions to other cities are not available. Tickets are non-transferable. Tickets do not earn frequent flyer mileage credit or points in any program. Paid upgrades or upgrades using frequent flyer mileage are not available. Prizewinner’s ticket may not be used to qualify for any promotional offer. Passengers are required to pay any applicable ticket and/or airport taxes that may be required at the time of ticket issuance. Taxes will be advised at time of booking. Once tickets are issued, any changes to the booking will result in a change fee. It is the responsibility of the winner to provide their own passport and visa application and entry/exit fees. Travel and hotel accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at the Sponsor’s sole discretion. The Grand Prize winner will be solely responsible for all other expenses not specifically set forth herein including but not limited to transportation, travel insurance (which is strongly recommended), taxes, meals, transfers, gratuities, souvenirs, fuel surcharges, port charges, and any other incidentals. The Sponsor reserves the right at their sole discretion to substitute the prize with another prize of equal or greater value in the event that any aforementioned prize is not available. All decisions by the Sponsor as to prize winner and prizes are final. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. 

Prize Conditions: The Grand Prize winner is solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or delivery or receipt of the prize. If a Canadian citizen wins the Grand Prize, they will be required to answer, unaided, a mathematical skill-testing question. The Grand Prize winner will be required to sign and return to the Sponsor an Affidavit of Eligibility, Acceptance of the Official Rules and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. Travel Liability Waivers will also need to be executed by all people accompanying the Grand Prize winner on the trip. If travel companions is a minor (under applicable state or provincial law), travel companion’s parent or legal guardian must sign and return all required documentation and accompany minor on trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner’s entry within five (5) days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The prize will be only awarded to a verified winner. The winner’s entry into the Sweepstakes and acceptance of the prize constitutes permission (except where prohibited by law) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) and/or prize information, without limitation, for promotional purposes, in all forms of media, in perpetuity, without notice or further compensation.  As a condition of being awarded any prize, except where prohibited by law, winner may be required to execute a consent to the use of his/her name photograph, likeness, statements, biographical information, voice and address (city and state) and/or prize information, without limitation, for promotional purposes without further notice or further compensation.  Prizes are not transferable.  No substitutions or exchanges (including for cash) will be permitted. The Grand Prize package will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

Terms & Conditions:  By entering the Contest, entrants agree to release the Sponsor and their respective subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and their respective and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries of any kind sustained in connection with their participation in the Contest or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize.  Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose.  Any person attempting to defraud or in any way tamper with the Contest mechanics and/or implementation will be prosecuted to the fullest extent of the law.  By participating, entrants agree to waive any right to claim ambiguity in the Contest or these Official Rules. The Sponsor reserves the right to disqualify any entrant that the Sponsor determines, in their sole discretion, violates these Official Rules.
